Introduction and Acceptance
Welcome to Common. These Terms and Conditions (the "Terms") govern the use of Common’s mobile application as well as its web pages, software, and related services (collectively, the "Application"). The Application is operated by SOMOS COMMON S.A.S. DE C.V. and/or its affiliates and subsidiaries ("the Company" or "Common"). By accessing or using our Application, you ("the User") agree to comply with these Terms. If you do not agree, you must refrain from using the Application. The Company reserves the right to modify these Terms at any time without prior notice.
1. Changes to the Terms
The Company may update these Terms for legal reasons or to ensure optimal service operation. If we make significant changes, we will make reasonable efforts to notify you through:
- An email to the registered address.
- An in-app notification.
The latest version of the Terms will always govern our relationship. If you continue using the Application after the changes take effect, you will be deemed to have accepted the new Terms.
2. Service Description
Common provides users access to an online community designed to help single men and women interact, form friendships, and grow in their Catholic faith. The service may include ads, administrative communications, and marketing messages that we consider an essential part of the experience.
The User understands and agrees that:
- Using the Application may require Internet access and a compatible device, the costs of which are your responsibility.
- The Application may display third-party advertising. The Company is not responsible for the products, services, or content of such advertisers.
3. Eligibility and Registration Obligations
To create an account and use the Application, you must be at least 18 years of age. As a condition of use, you agree to:
- Provide truthful, accurate, current, and complete information during the registration process (name, contact, photo, billing data, etc.).
- Keep such information up to date at all times.
If Common has reasonable grounds to suspect that the information provided is false or incomplete, it reserves the right to suspend or cancel your account.
4. Privacy and Personal Data
The information in your registration and other personal data you provide are subject to our Privacy Policy. By using the Application, you consent to the collection and use of this information in accordance with that policy and applicable law. Please see our full Privacy Notice for details.
5. Account, Password, and Security
Upon registering, you will create a password to access your account. You are solely responsible for:
- Keeping your password confidential.
- Ensuring that no one else uses your account.
- Taking responsibility for all activities that occur under your account.
Common will not be liable for any damage arising from failure to comply with these security obligations.
6. User Conduct and Content
You are solely responsible for all content (texts, photos, videos, messages, etc.) that you post or transmit through the Application. Common is not responsible for user-generated content.
6.1. Prohibited Content and Activities
You agree not to use the Application to:
- Transmit illegal, harassing, defamatory, threatening, obscene, or otherwise offensive material on sexual, racial, or any other grounds.
- Post or distribute material protected by copyright, trademarks, or other proprietary information without the prior consent of the owner.
- Impersonate another person, including Common employees.
- Post contact information or personal data of third parties without their consent.
- Send "spam", "junk mail", "chain letters", or any form of unsolicited mass communication.
- Use the service for commercial purposes, such as advertising or soliciting the purchase/sale of products.
- Contact other members for purposes contrary to Catholic moral teaching.
6.2. Interaction with Other Users
You are solely responsible for your interactions with other members. Common reserves the right, but has no obligation, to monitor disputes between users.
6.3. Monitoring and Removal of Content
Common has the right, but not the obligation, to edit, reject, or remove any content that violates these Terms. We may also monitor private messages if necessary to protect the safety of the Company or other users.
7. Payments, Subscriptions, and Refunds
- Subscriptions: To access certain features, registration and a valid payment method may be required. You will be subject to the terms of the applicable payment platform. Prices and subscription features may change without prior notice.
- No Refund Policy: All charges for purchases and/or subscriptions are non-refundable. No refunds or credits are issued for partial periods of use. Common is not responsible for charges generated by third parties (banks, payment platforms, etc.).
- Cancellations: You can cancel your subscription at any time, according to the terms of the subscribed service.
8. Intellectual Property
8.1. Company Property
The Application, its software, logos, trademarks, trade names, and all materials contained therein are owned by the Company or its licensors and are protected by intellectual property laws. You agree not to copy, modify, distribute, sell, or create derivative works based on the Service or its software.
8.2. User Content
By submitting content to public areas of the Application (such as photos or articles), you grant Common a worldwide, non-exclusive, royalty-free license to use, distribute, reproduce, modify, adapt, and publish such content in order to operate and promote the Application.
9. Account Termination
Common may cancel or suspend your account and access to the Service, without prior notice or refund, for reasons including but not limited to:
- Violation of these Terms.
- Requests from legal authorities.
- Your own request to delete your account.
- Fraudulent or illegal activities.
- Failure to pay due fees.
Termination of your account will result in the removal of your access and all content associated with it.
10. Disclaimer of Warranties
The Application is provided “as is” and “as available.” You use the Service at your own risk. The Company makes no warranties, express or implied, regarding the uninterrupted or error-free operation of the Application. We do not guarantee the accuracy, reliability, or quality of any content or advice obtained through the service. Common does not verify criminal records, marital status, or the truthfulness of users’ religious information. We do not guarantee the good conduct of members. You are solely responsible for your interactions.
11. Limitation of Liability
To the maximum extent permitted by law, the Company, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:
- Your access to, use of, or inability to use the Application.
- The conduct or content of other users or third parties.
- Unauthorized access to your data or profile.
- Errors, inaccuracies, or service interruptions.
The Company’s total liability, in any case, will be limited to the amount you have paid for the services.
12. Indemnification
You agree to indemnify and hold the Company, its partners, and employees harmless from any claim, demand, or damage (including reasonable attorneys’ fees) arising from your use of the Application, the content you submit, your violation of these Terms, or your violation of any third party rights.
13. General Provisions
- Confidentiality: The Company is committed to protecting your personal information in accordance with our Privacy Notice and applicable laws.
- Cookies: The Application or its associated web services may use cookies to improve user experience. You can configure your browser or device to reject them, although this may affect the functionality of some sections.
- Third-Party Links: The Application may contain links to third-party websites. The Company does not endorse and is not responsible for the content, products, or services of such sites.
